현재 Oregon에 거주중입니다
대략 2주전, Facebook Marketplace에 올라온 개인 매물 차량을 거래했습니다
판매글에도 Clean title이라 명시했고, 판매자가 보여준 Title도 Clean Title이었습니다.
거래하기로 한 금액은 4000불이며, 이체한도 때문에 3500불만 먼저 송금 후 차량은 제가 가져왔으며, 500불 잔금이 남아있어 Title은 판매자에게 있는 상황입니다 (Title 사진 보유중)
그런데 DMV에 가서 VIN inspection을 해보니 차량은 Total Reconstructed 차량이라고 합니다
이후 판매자에게 환불을 요구했으나 거절한 상황입니다.

Selling untitled vehicle prohibited
(1)A person commits the offense of selling an untitled vehicle if the person sells a vehicle without complying with the requirements under ORS 803.025 (Violating title requirements) and 803.045 (Issuance of title) to obtain a title for the vehicle or the requirements of ORS 819.016 (When salvage title required) to obtain a salvage title for the vehicle, as appropriate.
(2)The offense described in this section, selling an untitled vehicle, is a Class A misdemeanor. [1983 c.338 §187; 1985 c.393 §3; 1991 c.873 §35; 1993 c.233 §27]
위와 같이 나와있어 Small claims court에 고소할 예정입니다 (경찰은 Civil matter라고 접수를 안해주는 상황입니다)
이런 경우 변호사 없이 개인이 고소하면 승소가 가능할까요?
