Dear H&H Law Attorney,

I am currently an F-1 visa student studying biochemistry at UCLA and have been residing in the U.S. since 2019. My older brother, who is a U.S. citizen and owns an acupuncture clinic in the Los Angeles area, is considering hiring me as a bookkeeper—a position reportedly in shortage by the USCIS.

Given our familial relationship, I would like to understand the feasibility and any potential complications of him sponsoring me for an employment-based green card. Specifically, I am interested in knowing:

- How probable is it that an application for an employment-based green card in this scenario would be successful?
- What specific challenges do we face due to the employer-employee relationship being between siblings?
- Are there more effective alternatives we should consider?

Any guidance or additional insights you could provide would be greatly appreciated as we navigate this process.

    In general, employment-based sponsorship by an employer/company owned by a family member/relative is not recommended.  Please call our office for further clarification and guidance.
