한국이고요.. 얼마 전 변호사 만나고 왔습니다
첨에는 가능성 있다고 해서 만나러 갔는데
보자마자 하는말이 문과나오셨네요 였습니다
엔지니어인데 왜 문과를 나왔냐 그러시더라구요
Niw 는 관련 학과를 나와 경력 5년이 있어야 자격요건이 충족된다 라고 말하시더라구요
단 저 같은 케이스를 진행해서 다행히 승인받은 경험은 있다고 하시더라구요
그래서 선택은 고객의 몫이고 학위로 인해 거절당할 수있다고 말하시네요
근데 uscis 에 의하면
You must meet at least three of the criteria below* and demonstrate that it is in the national interest that you work permanently in the United States.
* Criteria
Official academic record showing that you have a degree, diploma, certificate, or similar award from a college, university, school, or other institution of learning relating to your area of exceptional ability
Letters documenting at least 10 years of full-time experience in your occupation
A license to practice your profession or certification for your profession or occupation
Evidence that you have commanded a salary or other remuneration for services that demonstrates your exceptional ability
Membership in a professional association(s)
Recognition for your achievements and significant contributions to your industry or field by your peers, government entities, professional or business organizations
Other comparable evidence of eligibility is also acceptable.
이게 자격요건인데
제가 엔지니어인데 문과를 나왔습니다
관련학과를 졸업 후 5년이라는 경력이 있어야 한다고 누군가 그러더라구요
저는 관련학과를 졸업하지 않았기에 자격요건이 안된다 라고 했습니다
근데 위 내용에는 그러한 문구가 보이질 않는데 뭐가 맞는지 모르겠습니다
혹 제가 모르는 다른곳에 명시가 되어있거나 판결문 등이 있을까요??
